  1. Acceptance of Terms

By accessing our services, downloading our app, purchasing our products, or engaging with Elev8 Journeys Limited (“we,” “us,” “our”), you (“you,” “your,” “client”) agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

  1. Services Offered

Elev8 Journeys provides:

  • Elev8 Nutrition App: Subscription-based fitness and nutrition platform with Bronze (£19.99/month), Silver (£39.99/month), and Gold (£69.99/month) tiers
  • Personal Training Programs: Including Journeys (£699) and Platinum (£999) packages
  • Digital Products: E-books, meal plans, workout guides (£3.99-£39.99)
  • Boxing Coaching: Group and individual sessions
  • Nutrition Consultations: Personalized meal planning and dietary guidance
  1. Age Requirements and Parental Consent

Services are available to individuals aged 12-55. For clients under 18:

  • Parental/guardian consent is required before service commencement
  • Age-appropriate training modifications will be implemented
  • Safeguarding protocols are in place as per our Child Protection Policy
  • DBS-checked staff will supervise youth training sessions
  1. Health and Safety

5.1 Medical Clearance

You must:

  • Complete our health screening questionnaire honestly and thoroughly
  • Obtain medical clearance if you have pre-existing health conditions
  • Inform us immediately of any changes to your health status
  • Follow all safety instructions provided by our coaches

5.2 Risk Acknowledgment

You acknowledge that physical exercise and boxing training involve inherent risks including but not limited to injury, muscle soreness, and in rare cases, serious injury or death. You participate at your own risk.

5.3 Insurance and Liability

While we maintain appropriate professional indemnity and public liability insurance, you are encouraged to maintain your own personal insurance coverage.

  1. Payment Terms

6.1 Subscription Services

  • App subscriptions are billed monthly via Stripe
  • Personal training packages are paid as one-time payments
  • All prices are in GBP and include applicable VAT
  • Payment is due in advance of service delivery

6.2 Refund Policy

  • Digital Products: No refunds after download/access
  • App Subscriptions: No refunds after download/access.
  • Personal Training: 48-hour cancellation notice required; unused sessions may be refunded at our discretion
  • 12-Week Journeys: Refunds considered on case-by-case basis within first 14 days
  1. Cancellation and Termination

7.1 Your Right to Cancel

  • App subscriptions can be cancelled anytime with 30 days’ notice
  • Personal training sessions require 48 hours’ notice
  • You retain access to paid content until subscription period ends

7.2 Our Right to Terminate

We reserve the right to terminate services if you:

  • Breach these terms and conditions
  • Engage in inappropriate behaviour toward staff or other clients
  • Provide false health information
  • Fail to make required payments
  1. Intellectual Property

All content, including but not limited to:

  • Workout plans and exercise routines
  • Nutrition plans and meal guides
  • E-books and educational materials
  • App content and functionality
  • Elev8 Journeys branding and logos

Remains the exclusive property of Elev8 Journeys Limited. You may not reproduce, distribute, or commercially exploit our content without written permission.

  1. Data Protection and Privacy

We are committed to protecting your personal data in accordance with UK GDPR. This includes:

  • Health and fitness data
  • Progress photos and measurements
  • Payment information (processed securely via Stripe)
  • Communication preferences

  1. Content Creation and Media Release

10.1 Transformation Documentation

For Journeys package clients, transformation videos and photos may be created for:

  • Social media marketing
  • Website testimonials
  • Promotional materials

10.2 Consent and Usage Rights

By participating in filmed content, you grant Elev8 Journeys perpetual, royalty-free rights to use your likeness for marketing purposes. Platinum package clients are exempt from filming requirements.

  1. Code of Conduct

All clients must:

  • Treat staff and other clients with respect
  • Follow facility rules at Body Carnegie Centre
  • Maintain appropriate hygiene standards
  • Report any incidents or concerns immediately
  • Respect confidentiality of other clients
  1. Limitation of Liability

To the fullest extent permitted by law, Elev8 Journeys Limited shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits or business opportunities
  • Damages exceeding the amount paid for services in the 12 months prior to the claim
  • Results not achieved due to non-compliance with program requirements
  1. Force Majeure

We shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including but not limited to natural disasters, government restrictions, pandemics, or facility closures.

  1. Complaints and Dispute Resolution

14.1 Internal Complaints Process

Complaints should be submitted in writing to support@elev8journeys.com and will be investigated within 14 working days.

14.2 Alternative Dispute Resolution

If internal resolution fails, disputes may be referred to mediation before pursuing legal action.

  1. Modifications to Terms

We reserve the right to modify these terms with 30 days’ written notice. Continued use of services constitutes acceptance of modified terms.

  1. Governing Law

These terms are governed by English law, and any disputes will be subject to the exclusive jurisdiction of English courts.

  1. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
